20/07/2022 - Current Pathways to Residence

There are currently three Pathways to Residence which may lead to Permanent Residence visas and, if so required, onto Citizenship;

  1. Skilled Migrant Category
  2. Green List occupations - two-year work to residence OR ‘fast track’ straight to residence
  3. Paid twice the median wage - two-year work to residence

1. SMC Skilled Migrant Category

This category is expected to re-open late 2022.

The SMC is a point-based system that recognizes skills, age and qualification and experience. It does not require employer support or any specific job, it is purely focussed on the migrant and their unique possible contribution to New Zealand.

A thorough and detailed calculation of the SMC points is essential to determine your eligibility and possible success, especially the recognition of experience and qualifications achieved overseas are pivotable.

SMC applications may be made from outside New Zealand or from within New Zealand.

2. Green List Occupations - Two year Work-to-Residence

Applicants can be within NZ or offshore.

This Green List is a list of jobs for which AEWV may be issued, with work-to-residence rights. Minimum qualifications or experience are applicable or, in some cases, a minimum income is required.

You may then apply for residence after two years of work in the job for which your AEWV was issued.

The employer is not required to advertise the vacant position.

Your partner will have Open Work rights.

2. Green List Occupations - Fast-Track Residence

Applicants can be in NZ or offshore.

This Green List is a list of jobs for which AEWV may be issued, with close to immediate application rights for residence applications. Minimum qualifications or experience are applicable or, in some cases, a minimum income is required.

According to INZ, these work visa are issued within 30 days.

The employer is not required to advertise the vacant position.

Your partner will have Open Work rights.

Fast track means here that you apply for a work visa say in July, you then could apply for residence in September.

3. Occupations paying twice the median wage - Two-year Work to Residence

Applicants can be within NZ or offshore.

All other jobs of AEWV holders that are paid at twice or more the median wage are eligible for a two year work to residence visa

You may then apply for residence after two years of work in the job for which your AEWV was issued.

The employer is not required to advertise the vacant position.

Your partner will have Open Work rights.

20/07/2022 - Current Work Visa Options under AEWV

The current work visa options are under the Accredited Employer Work Visa (AEWV) scheme.

The Accredited Employer Work Visa is an employer-supported work visa in three stages.

  1. The employer needs to be accredited (ALL employers wishing to employ a migrant are required to be accredited), and
  2. An approval for a Job Check to confirm and ensure no locals (NZ Citizen and or Resident) are available, and
  3. A suitably qualified migrant

There are three types of AEWV's available;

  • Occupations paying twice the median wage - leading to a two year Work to Residence

Accredited Employer Work Visas may be issued for jobs with newly accredited employers, and after confirmation that no locals are available for the role, a Job Check approval will be issued from Immigration NZ.

AEWV employees must be paid at least $27.76/hr. Some lower paid jobs ($25/hour) are allowed for up to two years in specific industries and job roles, and then require a one-year stand-down offshore.

For residence from AEWV, please assess the options under the SMC Skilled Migrant Category visa.

Partners need to qualify for their own work visa, or they may receive work rights of less than 30 hours/week.

  • Green List Occupations - leading to a Fast-Track Residence

Applicants can be within NZ or offshore.

The Green List is a list of jobs for which AEWV may be issued, with close to immediate application rights for residence. Minimum qualifications or experience are applicable or, in some cases, a minimum income is required.

Work visa are issued within 30 days.

 Employer advertising is not required.

Apply for a work visa from July, apply for residence from September.

Partners have Open Work rights.

31/05/2022 - ‘Waste of time and money': Employers and migrants bound to new visa

The government should be embarrassed it has introduced a scheme tying migrants to an employer when the Productivity Commission has just recommended the practice be stopped, according to an immigration lawyer.

The Prodcutivity Commission is recommending that residence should no longer be permanent, in an attempt to make migrants commit to New Zealand.

Instead, migrants would have to apply for citizenship, or renew their residence visa every six years.

Other recommendations in the commission's report are that immigration must be based on how well the country can absorb new arrivals and a greater role for Te Tiriti o Waitangi in settlement policy.

16/05/2022 - Update Immigration New Zealand

The Online Process

The enhanced Immigration Online system provides new functionality that enables more effective ways of working.  It streamlines repetitive administrative tasks during the visa application process which allows our people to focus on tasks requiring judgement.

Allocation is no longer the first step as immigration officers are no longer allocated an entire application, several may assess an application and processing steps commence as soon as an application is received.

The system may fully automate the processing of a visa if immigration instructions are met or trigger manual tasks for assessment.

11/05/2022 - Breaking News - New Zealand border reopening fully from end of July

Prime Minister Jacinda Ardern has confirmed the border will fully reopen from the end of July, including for cruise ships and international students.

It comes with a range of other immigration announcements, including sector-specific agreements to support a shift away from low-skilled migrant labour, and a new 'Green list' of 85 hard-to-fill high-skill roles that provides a priority pathway to residency.

Visas for some 20,000 migrants already in the country are also being extended, and there will be new restrictions on students being able to work.

Ardern, who is isolating with her partner at home, has announced the move virtually at a Business NZ lunch in Auckland this afternoon, with Minister of Immigration Kris Faafoi and Minister of Education Chris Hipkins at the event in person.
