Ministerials

This is the last step in the democratic process available to applicants. You may write to the Minister requesting him/her to overturn or intervene in the decision made by the INZ and or IPT on your application.

You may also write to the Minister if you believe that your situation is special. This may be applicable in some cases where applicants who do not meet the strict criteria of a certain current immigration instructions. The Minister then has the power to grant residence or direct INZ to re-assess the application.

Please make sure though that you have followed the democratic process and that the reason that you wish to write to the Minister is a result of being unable to solve the issue(s) directly with INZ

Please contact TNC for more information.

Citizenship

We also assist people in obtaining New Zealand Citizenship. It will usually take between five to eight months, sometimes twelve, from the time of lodgement to the time you will become a New Zealand citizen. This timeframe accounts for application processing, approval from the Minister and attending your ceremony.

Some of the conditions to be granted New Zealand citizenship is, that you must meet the requirements of either the Citizenship Act 1977 or the Citizenship Act (Western Samoa) 1982. You may meet the requirements of the Citizenship Act 1977 if you are:

  • an adult over 18 years meeting the general requirements
  • a child under 20 years meeting the general requirements
  • a person married to a New Zealand citizen
  • a person born outside New Zealand between 1 January 1949 - 31 December 1977, whose mother was a New Zealand citizen otherwise than by descent when they were born
  • a person in exceptional circumstances.

You may meet the requirements of the Citizenship Act (Western Samoa) 1982 if you are a citizen of Samoa.

All applicants must include original documents in their applications.

Section 61 (and 11)

It is possible that you are in New Zealand illegally, e.g. you do not have a valid visa, or, incorrect travel conditions.

When this occurs you become automatically an over-stayer. This is a serious offence and therefore should not be taken lightly as it may result in deportation from New Zealand with an automatic ban for 5 years.

Under certain conditions you may be able to lodge an application subject to Section 61 (and Section 11) of the Immigration Act 2009.

Residence Skilled Migrant

As the word Skilled Migrant implies, this category is based on Skills and Experience. These skills have been obtained through education and or may also be gained by the number of years of experience you have.

The objective of the Skilled Migrant Category is to provide for the grant of residence to people who demonstrate that they have skills to fill identified needs and opportunities in New Zealand, and are able to transfer those skills to New Zealand and link with local needs and opportunities. They are  able to demonstrate their ability to contribute to New Zealand both economically and socially, and are able to demonstrate their ability to successfully settle in New Zealand.

In meeting these objectives, the Skilled Migrant Category will maximise and accelerate the contribution of immigration to New Zealand through capacity building, sustainable growth and innovation, increase global connectiveness and build thriving and inclusive communities through focusing on a range of source regions to achieve a balanced programme and linking global talent with New Zealand's local opportunities.

The proces under the Skilled Migrant Category is in four stages;

  1. First, complete an assessment to ensure you score the required points (please note that these points change regularly).
  2. When you believe that you score the required points, submit you "Expression of Interest" (EOI) into the Pool.
  3. When selected from the Pool, normally there is a draw every fortnight, you will receive an "Invitation to Apply" (ITA).
  4. The ITA will be assessed by INZ and when succesfull, Residence (PR) will be granted.

For further or additional information please contact us.

.

The Government first deferred EOI selections for the Skilled Migrant Category and Parent Category in April 2020. The Government has not made a decision yet when these categories are being reviewed and re-activated.

Skilled Employment is determined by your level of education, the job title for your (offered) position and the level of your salary which changes every year
